directors and the code of ethics

i have had to cut and paste this as email read from the bottom up
however i think you will get the drift

I sent the attached letter to all the directors excluding Paul Reynolds on June 3rd 2010 , in letter form, not email, marked personal, private and confidential
As of today’s date I have not received either an acknowledgement of receipt of same ,or a response

Could you please therefore ask telecom via your instruction agent whether said letter will or has been acted upon .this can be done via the National Compliance manager Ruth Nelson or the directors themselves

Can I also request that I receive a copy of telecoms disciplinary process with the documents that are due to be forwarded to myself 220710

Please do not perceive my requests in any way as a threat, in any way shape or form as I’m only requiring the exact same thing telecom required of me prior to my dismissal that I do my job 100% correct 100% of the time In fact HR referred to it as micro-managing via their agent Iain Galloway



Paul,

If you have not had a response to your letter, it would seem the directors have chosen not to reply. They are aware that Telecom HR is dealing with your issues.

Telecom will not be providing a copy of its disciplinary process. Furthermore, we are instructed no such process was in place during your employment.

Just to be clear

1 Does the directors failure to address the issues raised in my letter indicate that the code of ethics will not be complied with

.or are hr going to be addressing my specific concerns, if so can we confirm a time line please, I believe 30days to be a reasonable period , confirmation of what steps will be taken ,who will be addressing it ,what form it will take

or will that be the role of Ruth Nelson the national compliance officer .or is she abdicating her role to HR can she also confirm her role

or is telecom just going to ignore it

as I’m I have interest from others avenues ,i.e. shareholders associations and in fairness to the directors and your client , I require absolutely no ambiguity what so either

2 What is telecoms reason for failure to produce a copy of the disciplinary process please explain

3 Is your statement that “we are instructed no such process was in place during my employment “referring to (A) a disciplinary process or (B) a micro-managing process

Specifically which process please, and who specifically is this information coming from .. Are you instructions coming from Hannah Sullivan if so, is she receiving them from within hr of is she receiving same from either Dalzell, Hoult ,and Young Specifically ..which person instructed her regarding this statement .and was that specific person part of the original dispute

We are instructed the code of ethics is an internal company policy which applies to Telecom employees. We therefore do not see the connection with the directors.

As you know Telecom, has a different view of the issues referred to in your letter. In addition, all issues related to your employment with Telecom were fully and finally settled by way of the mediated settlement you signed. This settlement included a substantial sum being paid to you. Your letter appears to be an attempt to pursue the personal grievance that the Employment Relations Authority has held you are statute barred from doing.

In relation to the disciplinary process, Telecom is under no obligation to provide it.

How we are instructed is confidential.

All matters related to your employment with Telecom have been settled and Telecom is not prepared to enter into further correspondence about this.

In your haste ,you have failed to provide an answer to question three could you please clarify the issues raised in the question as requested at your earliest

The connection of the code of ethics to the directors is highlighted within the document itself, they approved it,


To be very clear my letter is not an attempt to further pursue the personal grievance but to highlight unethical behaviour and have it addressed ,however the tone of your response indicates that it will not be addressed, the inaction speaks volumes . Question time at the next shareholders meeting will give me ample opportunity for myself or my agent to address the issue directly with the directors

To answer question 3 in more detail, my statement was in response to your request for a copy of Telecom's "disciplinary process". As previously advised, how we are instructed is confidential.

well people i will leave it entirely up to you to draw any conclusions you like about the code of ethics and the degree of importance telecom attaches to it
