was informed to day that employment lawyers are following my blog with interest

hope some of them jump in and offer comments and suggestions negative or postive all good

this is a direct copy of comunication regarding a possible breach around the confidentiality of the mediation process
Telecom in giving me all personal information are allowed to censor some of the information the letter doesnt make a lot of sense as its heavily censored

i was the main participant in this process so why on earth word they censor it
perhaps i will leave you to make your own conclusions

btw no i didnt get redundancy no doubt some judas got thirty sherkles for getting rid of me though
they saved themselves a considerable amount makes wonder what it was all about doesnt it

Yesterday when I cal’**** o ask if he had discussed any of the mediation detail with anyone he advised that he had talked to **** regarding the mediation process and that no $$ etc had been discussed.
He commented that he felt this was a ploy to derail the process as Paul was well aware *** and ***** were close and it would be easy to make an assumption of this. Initially he told “it looks like he is taking a retirement package”. He later advised that he did not say this recently - the discussion with regarding retirement was earlier when Paul had made everyone aware that he had requested this calcutation.

responds by saying “no no no its 26 weeks”
I questioned as to the 26 weeks said ****did not state this was related to retiring leave,
redundancy etc - it was a statement of “26 weeks”. said made the assumption that this would mean the end of Pauls career with Telecom if there was an offer on the table. made comment that it was not a lot to live on etc.. *************

Telecom New Zealand Limited - Privacy Act request

1. Further to our letter of 4 June 2010, we enclose all of your personal information held by Telecom in accordance with the Privacy Act 1993.

2. Telecom has become increasingly concerned by the nature of the allegations made about Telecom employees on your blog. This includes the defamatory statements made about Bridget Dalzell, posted on Saturday 3 July 2010. Telecom requires you to immediately cease any further defamatory comments about its staff and asks that you respect their privacy.

they are not allegtions i am just exposing the lies if it ends up in court good i can ask questions but this time when i asked questions and they lie to me it carries a penalty jail time cause its perjury
most of the time they didnt even bother in thier sheer argrogance to obey thier own process or rules




i have offered john a chance of rebuttal on this one yet to get reply

Telecom impugned my good name,

Pursuant to the truth

Can ms Dalzell provide me with the answers to the following salient point

No discussion took place where I verbally advised her that Mr. Dick was acting for me

I can independently support my statements she thus far cannot apart from her assertions

I have only had two discussions with ms Dalziel one occurred post a meeting with regard to the outsourcing of our Jobs to Manila .the other at her request and attended by Iain Galloway for telecom hr just prior to the disciplinary action

Ms Dalzeil .if as she advises, had additional meetings, discussions with me then these should be able to be verified ,via times, dates, meeting notes diary notes, phone logs ,access logs to the Hamilton site, travel arrangements etc (her office is not in Hamilton ) I require copies of the actual logs etc

Please also explain why you ,where not, as telecoms counsel, involved in correspondence with myself at a much much earlier date thus the words belie the actions that should have followed on receipt of knowledge that I had engaged a lawyer

can you advise me when I can expect a reply to concerns raised in email sent Mon 12/07/2010 12:31 p.m.

As per previous notes:
I view this a bullying tactic that serves no useful purpose ,it is a frivolous waste of every bodies time including the authorities.

I will make very plain and simple for everybody I am on the dole I don’t have the money I simply can’t give what I haven’t got

I am complying with the payment ,albeit at a minimal amount.

Talking about it is going to help how ?

So explain please where is the breach?

Mr. Rooney states that I can’t unilaterally state what amount and how I should pay, I reserve the same right.

I attended a mediation it which the outcome was that I resigned on the 20 th Aug 2009; by the Sept 3 2009, Telecom HR had me “blacklisted”.

This indicates at the very least a failure of good faith in the mediation conference;a possible breach of the rules around mediation, as well as premeditation and predetermination.

Telecom via John Rooney vehemently denies they have blacklisted me.

The effect of this blacklisting is in fact a “de-facto” restraint of trade across the whole industry, as all roads lead to Rome, all telephone wires lead to a Telecom building, so if I was lucky enough to procure a job with a sub contractor in the industry, the moment I applied for access cards to telecom infrastructure the blacklisting would negate the application

So telecom has effectively shut me out of the only industry I know; the unintended or perhaps intended consequences.

I have documented proof of this blacklisting.

I am in the middle of seeking legal advice with regard to this and am considering launching a statement of problem as soon as I have the facts I require.

The outcome of this next meeting with the authority may or may negate the purpose of this one

So I’m not playing this game it just another way for telecom to inflict more pain, exactly like the micromanaging they put me thru knowing full well the targets where unachievable.

Well sorry folks full and immediate payment is unachievable.

So no I won’t be attending a telephone conference

And I will not be addressing this specific subject again

Stephen I want this note passed to Vicki if she is alarmed at the black listing I am happy to provide evidence direct to her .

However I will not be gagged on it as I fully intend taking same to the press

Please do not consider this as an affront to either yourself or Vicky or the Authority it is not the intent.

directors and the code of ethics

i have had to cut and paste this as email read from the bottom up
however i think you will get the drift

I sent the attached letter to all the directors excluding Paul Reynolds on June 3rd 2010 , in letter form, not email, marked personal, private and confidential
As of today’s date I have not received either an acknowledgement of receipt of same ,or a response

Could you please therefore ask telecom via your instruction agent whether said letter will or has been acted upon .this can be done via the National Compliance manager Ruth Nelson or the directors themselves

Can I also request that I receive a copy of telecoms disciplinary process with the documents that are due to be forwarded to myself 220710

Please do not perceive my requests in any way as a threat, in any way shape or form as I’m only requiring the exact same thing telecom required of me prior to my dismissal that I do my job 100% correct 100% of the time In fact HR referred to it as micro-managing via their agent Iain Galloway

If you have not had a response to your letter, it would seem the directors have chosen not to reply. They are aware that Telecom HR is dealing with your issues.

Telecom will not be providing a copy of its disciplinary process. Furthermore, we are instructed no such process was in place during your employment.

1 Does the directors failure to address the issues raised in my letter indicate that the code of ethics will not be complied with

.or are hr going to be addressing my specific concerns, if so can we confirm a time line please, I believe 30days to be a reasonable period , confirmation of what steps will be taken ,who will be addressing it ,what form it will take

or will that be the role of Ruth Nelson the national compliance officer .or is she abdicating her role to HR can she also confirm her role

or is telecom just going to ignore it

as I’m I have interest from others avenues ,i.e. shareholders associations and in fairness to the directors and your client , I require absolutely no ambiguity what so either

2 What is telecoms reason for failure to produce a copy of the disciplinary process please explain

3 Is your statement that “we are instructed no such process was in place during my employment “referring to (A) a disciplinary process or (B) a micro-managing process

Specifically which process please, and who specifically is this information coming from .. Are you instructions coming from Hannah Sullivan if so, is she receiving them from within hr of is she receiving same from either Dalzell, Hoult ,and Young Specifically ..which person instructed her regarding this statement .and was that specific person part of the original dispute

We are instructed the code of ethics is an internal company policy which applies to Telecom employees. We therefore do not see the connection with the directors.

As you know Telecom, has a different view of the issues referred to in your letter. In addition, all issues related to your employment with Telecom were fully and finally settled by way of the mediated settlement you signed. This settlement included a substantial sum being paid to you. Your letter appears to be an attempt to pursue the personal grievance that the Employment Relations Authority has held you are statute barred from doing.

In relation to the disciplinary process, Telecom is under no obligation to provide it.

How we are instructed is confidential.

All matters related to your employment with Telecom have been settled and Telecom is not prepared to enter into further correspondence about this.

To be very clear my letter is not an attempt to further pursue the personal grievance but to highlight unethical behaviour and have it addressed ,however the tone of your response indicates that it will not be addressed, the inaction speaks volumes . Question time at the next shareholders meeting will give me ample opportunity for myself or my agent to address the issue directly with the directors
