what i will be requesting of telecom

this is the paperwork that i will be requesting of telecom ,after i present my submissions on thursday .unfortunately the telecom lawyer indavertantly via a miscommunication recieved the request a little early however no damage done

however careful reading and a little thought will expose what transpired in my ousting

the next post of the submissions will expose the lies



I request the following of Telecom, so as to substantiate the basis of my appeal to the authority.
• Details of meetings and meeting notes, including diary entries indicating the original complaint of non performance and issues raised by Shaun Hoult.

• All relevant documents pertaining to the completion and acknowledgment of achieving, an agreed outcome between myself and Shaun Hoult. It was agreed between us that the issue had been dealt with and resolved.

• Information, as to why the issue was raised again after being dealt with as per above.

Information with regard to the process of what prompted the instigation of micro- managing.

• The legality of same as asked for, when compared to requirements of health and safety amendment act 2002 .

Who’s decision was it to micro-manage me out. Micro-managing was admitted to on more than one occasion by all of those involved ,Ian Galloway, Shaun Hoult and Michelle Young.

Who’s decision was it to continue to micro-manage in spite of the obvious stress being placed on me as per my medical reports and expression of concern by my union rep as this I feel is breach of the Health and Safety amendment act 2002.

• All information gathered on myself by Telecom in relation, to all details presented to me, at the initial meeting that occurred with Shaun Hoult, Team Leader on said Sunday night in late 2009.

All records of all other staff employed on site covering, the same time period , matching the same criteria and intensity as mine in each, and every way (Micromanaged) It is my contention that the records requested do not exist, and even if they do they, will not cover the same format as alluded to above, therefore failure to produce this documentation would support my claim that I was singled out to be managed out. these measurements for Refer data set mentioned in meeting notes of 270709 there should be a minimum data matching the entire site.


To produce a full account demonstrating all other Customer Service Representatives that failed to match the criteria that I was judged , reprimanded and dismissed on. If it was a fair and just process there should be records of all employee dismissal’s that would match this criteria. Failure to produce same would again support my claim.


To produce a full account of the survey/report done by Terri Wilson, Call Center Manager. This demonstrates that no staff on the entire site were doing the job properly, and none were matching the expectations required of me, which again would support my claim.


To produce all of Michelle Young’s documents notes relevant to this dispute. This is to include full meeting notes of Ian Galloway, Shaun Hoult and any meeting notes or other correspondence between all the above and others directly relating to this dispute. As meeting notes will show that I was continually told others were achieving, and I was not by Michelle. When I asked for verification of same Michelle quoted the privacy act as her way of not providing the information. Surely as a standard measurement procedure names can be removed and the information will still be relevant. My contention is that this did NOT exist and was used as a way of undermining my confidence and a way to exit me. Therefore if this information does exist, it can still be produced now.


As this is a process of listening into calls using a set criteria there is a opportunity to preempt the result as part of the micro management. An independent audit of this data would give further credence to the fact I was singled out for a predetermined result.


All conversation notes ,emails dairy notes correspondence to/ from all related parties including, human resources ,legal opinions and others to include same between all participants inclusive of Bridgette Dalzell, Michelle Young ,Shaun Hoult, Iain Galloway ,Hannah Sullivan Peter Cooper-Davis Sandra Cleaver , Dr David Prestage, the Department of Labor, Sheryl North , Trish Keith ,Debbie Herlihy ..Bryan Abraham These are required to prove or disprove the culpability of individuals in the decision to micro manage me out.


• Telecom's counsel indicate the documents are required to be confidential, individuals privacy not directly relevant to the various events will be respected, I am aware that these proceeding are open to the public and wish to exercise that opportunity. As stated in previous emails my name has been impugned, Telecom has tarnish my reputation for honesty and integrity my departure is the subject of discussion on the internet “facebook” where mention is made “I left under a cloud “ it is my intention to prove otherwise by any means at my disposal.


Refer email sent 230709 Michelle Young . These are serious issues I raised as to the legality of the micro-managing process I was being put through. The response was not to address the issues, but to concentrate solely and immediately on a process to exit me, confirmed by Hannah Sullivan’s responses, so whose decision was it not to address the issues.?
• Please provide the documentation. Of these discussions


Meeting notes .270710 in your own current attachment indicate I was invited to “raise any queries” Difficult questions were constantly asked of management yet to my knowledge none received the serious attention they required, none where answered .Telecom failed in their own promises to me why ???? They perhaps failed in their legal requirements to me.


It is clear they were becoming frustrated and saw the mediation as a process to achieve their requirement, fully aware that mediation would be the result of a final written warning if fact Iain Galloway had indicated to me in a discussion outside the building that this would all end in mediation and so it did


• I emailed a copy of my discussions with Bryan Abraham national manager health and safety to Iain Galloway which should be indicated the meeting minutes (where are those meeting notes please provide) of same are any notes emails memo between Iain and Bryan indicating that Iain was seeking to address my question. His failure to peruse or produce gives credence to my contentions that the whole process was predetermined please produce the documentation, as it is central to my argument.


Please ask of telecom dated documentation pursuant to any hazard control plans they had in place as required by law to deal with stress as a hazard in the work place and why these were not presented to me in rebuttal to my queries regarding same? Did they in fact exist? Where they presented to the department of labor ? If not why not? Where are they ..if they weren’t presented or do not exist then telecom may be found in default under the employment act Para 235 obstruction (1) (a) (b).

• I is my contention when all records are produced in the strict chronological order I requested, that the inadequacy of the process will become clear; which if why I feel they fall inside the category

Privacy act breach A request was made to Hannah Sullivan (HR) Telecom; for an explanation regarding the failure to follow the precepts and principles of the privacy act this request was made via privacy officer for telecom Tanya Bowers pertaining to Bridgette Dalzell accessing and reading private correspondence. This correspondence was between myself and “lawyer”.
The document produced amounted to at least 12 pages and it was my request to Tanya Bowers that each and every question be answered specifically, as this is the agreed standard that telecom was requiring from me 100% correct 100% of the time. The timeframe was indicated that the information was to be given to me before 1 April 2010 and to date I have not received the required results. Please pursue

Telecom is satisfied it has complied with the Member's Minute of 16 March 2010. It does not consider the vast amount of documents requested by Mr Evans-McLeod to be covered by the Minute. It appears Mr McLeod wishes to reopen issues that pre-date the signing of the mediated settlement agreement which is clearly not the purpose of Thursday's investigation meeting.

stating that as my aplication didnt specify the relevance as to why certain documents were requested that they would not be required to be produced at the investigation meeting 1 april 2010

on well its all a learning experience when you are puddling along on your own

Statement pertaining to relevance of documents requested for investigation meeting April 1 2010

1. I refute their claim paragraph 4 (d) of statement of reply


‘’ that the second third and fourth respondents were, at all times, acting in the proper
Performance of their duties with the first respondent “

It is my contention that the respondents were “not acting in the proper performance of their duties” in that they failed to offer me, as required under the act, “the same terms of employment and conditions of work as other employees with the same or similar qualifications, experience or skills working in the same or similar circumstances “
3. Furthermore I suffered dismissal, discrimination, humiliation and detriment by the employer and their representatives (the respondents) in circumstances in which other employees doing the same kind of work are, where or would be treated in the same way.

now it is going to get interesting

stephen has replied to my requests and is getting an authority member on to it to sort telecoms legal consul out

so now telecom will be forced to supply the details requested previously

they are going to hit the roof

they are required to supply

answers to approximately fifty breaches of the privacy act

who esle apart from brigette dalzell was across my emails who also breached the same fifty breaches

The authority as written to me with pursuant to the next part of the process I am required to provide the following in time for a conference call between all parties and their representatives scheduled for 11.3O am March 4

1. attendance at mediation
2. discussing the time date and venue for the investigation meeting
3. timetabling of information to come to the authority
4. identify the number and identification of witness
5. checking the remedies sought
6. outlining the process of the investigation meeting ,clarifying any issues

I require from yourselves, to enable me to fulfill the requirements of item 4 ,

The number and identity of all attendees to all and any meeting in which Bridgette Dalzell was in attendance including all or any “boot camps” “conferences” .conference calls “. team meetings” in fact any action

Any and all team leaders that where on site while Bridgette Dalzell was in attendance and or at the Hamilton site in the time period that Bridgette was acting as seconded national manager and or any other time she was on site or in attendance

Including any and all recipients/participants of any emails, memos, notes voice calls ,one on one meetings that are pursuant to the above concerns in all matters discussed


I require copy’s of all medical details /certificates/doctors notes etc, plus a copy of the issues I was dealing with in my personal life received by you from me and a note of the dates received at your ,earliest possible convenience

The purpose of the investigation meeting on 1 April is for the Authority to consider two preliminary issues. Namely, were the second, third and fourth respondents your employer and is your claim barred because of the mediated settlement agreement you entered into. We do not consider the information and documents requested in your emails of 24 and 26 February or your email of 5 March to be relevant to these two preliminary issues. Nor do we consider the information is required to enable you to complete your submissions.

The information may be relevant to your claim of unjustified dismissal, however, as was explained at the Authority teleconference, any such claim can only proceed if the Authority determines it is not barred by the mediated settlement agreement. In these circumstances, the respondents will not be providing the information you have requested at the present time.

A former Telecom call centre worker says he was bullied into leaving the company and has filed a complaint with the Employment Relations Authority.

Paul Evans-McLeod, who worked in Telecom's Hamilton call centre for 12 years and at the company for 39 years, says he became angry after his bosses did not acknowledge a heart attack that he suffered in 2008.

He says he returned to work feeling "aggrieved" and that affected his work.

"I wasn't giving customers all the details ... I got caught not doing my job."

He was reprimanded for his behaviour and thought that was the end of it but human resources staff kept raising the issue and began to "micromanage" him – pulling him up for looking at a work email while talking to a customer and for voicing concerns about the launch of the XT network, he says.

"It was the micromanaging I couldn't deal with ... in the end they wore me down."

Mr Evans-McLeod took a personal grievance case against the company and reached a settlement in August – the terms of which are confidential – which precluded him from taking further action against Telecom.

But he says his dismissal was unjustified and he believes Telecom acted illegally in the process – by reading and acting on his personal emails.

"I want to clear my name and the sheer injustice of what they got away with to be recognised. My marriage is in tatters because of the stress I've been under for the past six months and I've been told this could be affecting my health."

Call-centre staff were not adequately trained before the launch of Telecom's troubled XT mobile network, he says.

"Some customers had to wait a week before they got it [connected to XT] ... we did not know what was going on."

Telecom spokeswoman Katherine Murphy says Mr Evans-McLeod reached the settlement with Telecom with support from his lawyer and an Engineering, Printing and Manufacturing Union representative. "We can't comment on his current complaint to the Employee Relations Authority as it is before the court."

Call centre staff underwent up to 16 hours of training before the launch of XT, staff were assessed to see if they required more tuition and training continued after the network's debut, she says.

"A launch of that size undeniably brings with it some challenges, however, feedback from staff on the training at the time was positive." bull shit ev erybody including the trainers were bitching it train wreck rushing to towards a landslide

serious complaint made to telecom

This is a serious complaint an I wish it to be treated with the utmost integrity by someone in the upper levels of management
Over the last few weeks I have become aware of someone making discreet inquiries of people I may or may not have communicated with that are still employed with telecom at first I thought it was happenstance the second time I thought that is a coincidence

Unfortunately I don’t believe in coincidence I indicates to me that someone within telecom is across my account and or the screens in their systems checking who I’m calling and or in contact with

As every action in the system leaves a footprint I am requesting a forensic audit of my details and an investigation as to who the individuals are that are accessing this information

I have made some changes and these should be acknowledged in the account memo and those are accepted however the others are not I consider this an abuse of my privacy and my rights

If this is not the right area to address these details please advise the correct one who ever it is who deals with internal

the conference call

Well I had the conference call with the employment relations authority and telecoms lawyers and the process is starting

I am now required to give submission as to

1 why the respondents are considered my employer

2 why the mediated settlement should not apply than we have a meeting on April 1st at 10 am

re these matters and a lady named Vicky will determine that based on the evidence produced

lots to consider so will have to research my notes

How telecom crushes dissent or awkward questions

Let’s say I’m still in Shaun Hoults team

I ask a question and don’t get the answers I want I feel I have been taken for granted not treated with respect or whatever my compliant may be

So I think stuff it I’m not being listened to so I will go straight to the top for the sake of this exercise we will say the area I’m talking about is HR so the top man is Wayne peat or he was when I was there

So Wayne gets the email to deal with it he communicates back down the structure he either goes to the head of my area Trish Keith and says what gives she may go to national manager or he may go straight to the Call Center Manager either Sheryl North or Michelle Young

Now here is where it gets interesting you ,you dumb bugger have just landed yourself in some grief for making all those managers above you look like they haven’t got a handle on their staff

None of those above you want very senior management looking over their shoulders cause they to busy sacking staff to earning their 30 shekels towards the next promotion auction

So one of two things happen your boss is called in
And he gets his arse kicked or he suddenly finds himself performance managed until he gets the message or works out why

Sound familiar have you seen it happen

Now’s here the rub

I once got a big prize for asking questions $1500 ,a visit to Hotel de Vin a big spread ,met and sat at a table with the Evers-Swindal sisters Theresa Gattung was there all the big wigs BIG DAY LOTS OF FUN AND THANK YOUS CAUSE SOME OF MY QUESTIONS SAVE THEM MONEY

Something happened recently and then it happened again

i,m patiently waiting for the third time it will come oh dear silly people

I thought to myself that’s a coincidence funny what life pops up with

Only thing is I don’t believe in coincidences which means someone in telecom is that concerned about me,

that they have done something illegal something career destroying silly silly people


Proves one thing though power doesn’t develop character it displays it

Very very disappointing but not however surprising

Remember the immortal line in Goldfinger. "Once is Happenstance. Twice is Coincidence. The third time it's Enemy action".

bosses should carry the can


Warren Buffet never said it so well as in his annual letter to Berkshire Hathaway’s share holders Buffet encouraged other corporations to develop meaning full penalties for top executive who misjudge risk so they will be more careful

Buffet lamented the fact that shareholders not chief executives and directors have borne most of the burden of company failures during the current economic crisis .he states boards are derelict if they do not insist that the CEO bare full responsibility for risk control if he fails at it the financial consequences for him and his board should be severe

It is long overdue to stop screwing those at the work face and leaving them to face the flack for the incompetence of those that should know better considering the ridiculous remuneration paid

Time for people to ask deeper and more searching questions around the xt launch your missing something that could blow it wide open follow the money have a much closer look at the specs

Telecom has appointed an independent party to investigate the debacle but shareholders should be demanding answers to a number of basic questions, including:

did the company have an open and contestable tender process for the construction of the XT Network? why was Alcatel Lucent appointed? Was the appointment based on price or some other issue?

Did Telecom comprehensively test the XT Network before it was launched? Thats a good question

Why was the XT Network aggressively marketed before it was completed?

Why is there no reliable backup when the system fails? Another good question

Question
why where employees who questioned some aspects of the launch aggressively quashed at the behest of their national managers when they voiced their concerns and then in a formal written warning told

“ It is your responsibility to ensure that you fully participate positively in all training sessions, team meetings and associated events; you are to support your colleagues, your team leader and the trainer.”

If you seek the counsel of yes men you reap the wisdom of mediocrity”


The one that are question your actions are at least thinking about it and are engaged in the process with you
